7:00 p.m. REQUEST FOR DETERMINATION OF APPLICABILITY 270 Shrewsbury Street – Mount View Middle School - Town of Holden - Assigned to Kenneth Strom, The applicant submitted a letter agreeing with the Conservation Commission’s opinion that a Notice of Intent was required for the construction of the driveway entrance over a catchment area containing bordering vegetated wetlands.    Kenneth Strom made a motion to issue a positive determination requiring the filing of a Notice of Intent, Michael Scott seconded the motion, motion passed 7-0, all were in favor.  

NOTICE OF INTENT - 92 Cimarron Lane, Lot 3 – B.A. Sundin & Son, Inc. Assigned to Michael Scott.  A revised plan was presented at the meeting.  The grading within the drainage easement was amended to allow for backhoe access.  David Clarke, Applicant stated the boulder wall will be constructed with rip rap and mirafi fabric.  The Commission asked for a cross section and details of material.  The Applicant stated maintenance responsibilities of the pond would be the lot owners, it would exist as other ponds within subdivisions that did not have a Homeownership Association.  

Richard Welch, 96 Cimarron Lane expressed concern regarding the detention pond maintenance.  Mark Fernandez, 101 Cimarron asked how residents could be assured the pond is operating efficiently.  Michael Scott stated the pond appeared to be operating as designed.  Nancy Fernandez stated she has witnessed a reduction in the flow of water, the Commission informed her the last few years have been drier than average and it could just be a product of the weather.  

The Commission unanimously voted to continue the hearing to the February 6, 2013 meeting and requested a detail of the boulder wall and erosion control details for construction.   
                                
ABBREVIATED NOTICE OF RESOURCE DELINEATION 143 Quinapoxet Street - SGG Realty Trust Assigned to Robert Lowell.  Goddard consulting submitted an ANRAD to confirm the boundary of a bordering vegetated wetland located 143 Quinapoxet Street.   Larry Greene represented the Applicant.  There was approximately 9” of snow on the ground which prevented the Commission from conducting a site visit to confirm the delineation.  The Commission unanimously voted to continue the hearing to the February 6, 2013 meeting and stated a site visit would be conducted if significant snow melt occurred.    

20 WOOD STREET - Wayne Rocheleau – Scott Morrison presented an informal plan to obtain guidance in preparing a NOI Application under the local bylaw.    The property contains a single family home and established yard, there is a uncertified vernal pool located northeast of the home.  Mr. Morrison presented three development options for the construction of a garage.  The Commission preferred the option closest to the resource area, as it created less impervious surface, resulted in the least amount of disturbance and was located in established lawn.  The Commission may ask for some type of compensation for allowing construction in the resource area, i.e.  restoration of existing lawn or a conservation restriction.  

CERTIFICATE OF COMPLIANCE – LOT 2 - 20 Putnam Lane – K&R Developers  A thorough inspection could not be conducted due to the snow cover, the item was continued to the February 6, 2013 hearing.

The next meeting is scheduled for February 6, 2012

The January 2, 2013 meeting minutes were approved on February 6. 2013.
